Terms of Service

The short version

You own your memories. We provide the tool. Be a good human. Orca is a memory aid — always have a backup plan for critical dates and deadlines.

1. Acceptance

By creating an Orca account or using the Orca app, you agree to these Terms of Service. If you don't agree, please don't use the app. These terms apply to all users of Orca, including free and paid subscribers.

2. What Orca Does

Orca is a personal memory capture and retrieval app. You speak, type, or photograph information, and Orca stores, organizes, and reminds you of it. Orca uses on-device AI (Sonar) to categorize your memories. This processing is not perfect and may make errors — you can always correct classifications manually.

3. Your Content

You own everything you put into Orca. We don't claim any rights to your memories.
You're responsible for the content you store. Don't use Orca to store illegal content.
We may analyze anonymized, aggregated usage patterns to improve the service, but we will never access, read, or share your individual memories.

4. Account Responsibilities

Keep your account credentials secure. We're not responsible for unauthorized access due to compromised credentials.
One account per person.
You must be at least 13 years old to use Orca.

5. Free & Pro Plans

✦ Orca Pro

Orca offers a free tier with unlimited memory capture and local storage. Orca Pro is a paid subscription that unlocks additional features including cloud sync across devices and future premium features.

Orca Pro subscriptions are billed monthly or annually through the App Store.
Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
You can manage and cancel subscriptions in your App Store account settings.
No refunds are provided for partial subscription periods, except as required by law.
Pricing for Orca Pro will be clearly communicated before purchase.

6. Third-Party Services

Orca integrates with third-party services to enrich your memories:

ESPN: Used to fetch sports scores, schedules, and standings for teams you follow. Only your team name is sent to ESPN — no personal data.
Yahoo Finance: Used to fetch stock quotes and price data for tickers you track. Only the ticker symbol is sent — no personal data.
Supabase: Used for cloud sync and data storage. Your data is encrypted at rest and in transit.
Mixpanel: Used for anonymous, aggregated usage analytics. No memory content is ever included.

7. Service Availability

Orca is provided "as is." We aim for high availability but don't guarantee uninterrupted service. Core features — capture, browse, and local reminders — work offline. Cloud sync requires an internet connection.

8. Limitation of Liability

Orca is a memory aid, not a critical system. Don't rely solely on Orca for time-sensitive obligations such as medical appointments, legal deadlines, or financial due dates. We are not liable for missed reminders or lost data, though we work hard to prevent both.

9. Termination

You can delete your account at any time from Settings within the app. Upon deletion, your data is removed from our servers within 30 days. We may terminate accounts that violate these terms, with or without notice.

10. Changes

We may update these terms from time to time. We'll notify you of significant changes through the app or by email. Continued use of Orca after changes constitutes acceptance of the updated terms.
